[Fox News]  A Florida mom is suing a hospital after a nurse reportedly cut off part of her infant daughter’s finger while removing an IV, myFOXtampabay reports. Veronica Olguin is suing the Heart of Florida Regional Medical Center after the incident in October. Olguin’s 3-month-old daughter Selena had been in the hospital for three days recovering from a high fever. When a nurse went to remove the tape that attached the baby’s IV with scissors, she severed part of the child’s finger. “There was blood everywhere. It was all over her shirt, it was on my shirt. It was on my face. I held her face close to my chest. She was red, she was screaming,” Olguin said. Olguin’s attorney Lou Pendas says both the nurse and the hospital were negligent. “The nurse threw the scissors used to sever the pinky in a panic. She rushed out of the room, screaming, and that’s when the doctors rushed back into the room,” Pendas said. About half of Selena’s finger was found on the floor, but the veins were too small to reattach it. Pendas claims that while attorneys for the hospital were responsive to him at first, they stopped responding, forcing him to file the lawsuit. The hospital released a statement through their attorneys, saying, “We deeply regret the harm to the child and want to reiterate our compassion and concern for her and her family. We reached out right away to the child’s family and their attorney, but have not been able to reach a mutually agreeable resolution. We want to reiterate our compassion and concern for the child and her family.” Richards Ford with Wicker Smith out of Orlando, which represents the hospital, told myFOXtampabay the nurse is back at the hospital, but he couldn’t say whether she was working with patients or not. Olguin says she still has nightmares about the incident, and she believes Selena does too. “I saw everything. And it’s really hard what I went through. And I can’t imagine what she went through,” she said. Olguin claims Selena wakes up crying often in the night, and she worries for her child’s future in sports and school without a finger. “It’s really hard that she, she was born so perfect.,” she said.

[Daily News]  The mother of “Toddlers & Tiaras” star Isabella Barrett has filed a multimillion dollar lawsuit against three media outlets, claiming their reporting tried to sexualize the 5-year-old’s performance in a web video. The $30 million libel suit, filed Tuesday in Manhattan Supreme Court against TMZ.com, The Huffington Post and London’s Daily Mail, stems from the kindergartner’s videotaped rendition of the LMFAO song “I’m Sexy and I Know It.” Online articles published by the three outlets “brazenly attempt to sexualize” the girl by “claiming she was gyrating in a nightclub and singing about her sex appeal” the suit charges, when she was actually sitting down during the Jan. 9 taping at a Manhattan restaurant. In the video, Isabella wears a pink tutu and is seen bouncing in the deejay booth as she sings to a cheering crowd. The articles claimed the girl’s mother, puppy boutique owner Susanna Barrett, pressured her into performing on the video, the suit states. But the person seen encouraging the child on the tape is a celebrity disc jockey who was hired for the fund-raising event at Libations, a new bistro on Ludlow Street, according to the suit. “Isabella Barrett did not act or portray herself sexually, erotically or provocatively; she was not ‘gyrating’ at a ‘nightclub’ or singing ‘about her sex appeal,’” Susanna Barrett claims in the court papers. “On the contrary, it is the defendants who, through their articles, have thrust these false and vulgar characteristics on to Isabella. As a result, Isabella is now perceived sexually, erotically and pornographically,” and the articles “have placed Isabella in serious physical danger, attracting the attention of others who would seek to sexualize a child.”

[StarPulse]  Kim Kardashian’s estranged husband Kris Humphries is planning on suing the socialite to the tune of $10 million over his role on Kim and sister Kourtney’s reality show, Kourtney and Kim Take New York. An insider tells Life & Style magazine that “Kris has a legal team investigating his options,” and has met with lawyers to explore his options. “He’s claiming his role on Kourtney & Kim Take New York is bigger than he was told, and that’s why he wants more money,” says the source. “But Kris is also suing because he’s really worried about how badly he’s going to be portrayed on the series.” Humphries is mostly concerned about his ‘good boy’ image and is trying to keep producers of the show to keep certain incidents involving reported bad behavior – scheduled to air mid-season – from being broadcast. One incident involved Kim’s long-time best friend Jonathan Cheban, who Kris reportedly bullied and grilled over his sexuality. Another source tells Us Weekly that Kris called Kim names and belittled her in front of other people and spent most of his time out partying without her. “He’d call her stupid. It was truly sickening. He tried to control Kim by bringing her down,” says a family insider. “He would say truly terrible things. One time, he said she had no talent and her fame wouldn’t last.” Humphries also reportedly called her “fat ass”and even told some of his friends that her “butt is fake.” The NBA player even spent time in Miami without Kim and let “random girls” give him lap-dances and cozy up with him.

[HuffPo]  For Mary Bach, 2 cents isn’t chump change. The Pennsylvania woman took Walmart to court over a two-penny discrepancy on her receipt — and won. Bach was shopping at a Walmart in Delmont when she picked up a package of Banquet “Brown ‘N Serve” sausage, listed at 98 cents, according to the Pittsburgh Tribune-Review. When the cashier rang up the the breakfast meat, the item scanned at $1. Bach says she pointed out the cashier’s error and accepted a refund. But when she returned several days later and was overcharged again, Bach decided that a refund wouldn’t cut it. She filed a civil suit against the retail giant — a practice the consumer activist has made a habit. “This is the fifth lawsuit that I have now won against this store, this Delmont Walmart for the same problem: practice of putting up a shelf tag that was lower than the price charged at the cash register,” Bach told WPXI. Walmart lawyers alleged that Bach only purchased the meats so she could file another suit against the biggest of big box stores, according to the Trib. The store’s attorneys said Walmart had just changed its sausage packaging, meaning older meats — priced at 98 cents — and newer meats — priced at $1 — were both available. Bach was awarded $100 in damages and about $80 in court costs, the Trib notes.

I shit you not, this is actually a true story. Martha fucking Stewart here goes to buy some frozen sausage at Wal-Mart, which run her a whole $0.98, and when she brings it to the register, she’s overcharged an extra $0.02 – a whopping $1 for a box of sausage links. Now, I don’t blame here because I’m so cheap you could slap a ski-slope nose on me and call me a Heb, but  Banquet “Brown ‘N Serve” sausage are certainly worth the extra two cents, honey.   (more…)

[USA Today] NANUET. N.Y. — Martin Kessman says he loves White Castle burgers and has been eating them for 50-plus years, but the 290-pound stockbroker doesn’t like that he can’t fit into the booths at his local restaurant. So he’s suing. He filed a federal lawsuit last month against the fast-food chain claiming the small seating violates his rights under the Americans with Disabilities Act. He also accused White Castle of reneging on its promise to upgrade its seating with more space between the table and back of the bench to accommodate heftier customers. Kessman learned he couldn’t fit into the restaurant seating in April 2009. His inability to fit into the “booth-style seating” was “extremely embarrassing … to have to experience in front of a restaurant full of customers,” according to his lawsuit filed in U.S. District Court in Manhattan. Kessman argues in his lawsuit that he received three patronizing letters from White Castle after complaining about the seating. His lawsuit claims he became disappointed with the lack of attention to his problem with the seating.

I hate all of these ridiculous lawsuits. It’s one of the reasons why our country is going right down the shitter. Everyone is too busy blaming someone else for their problems and expects anyone around them to bend or break to conform to their specific needs. Got diabetes after drinking a liter of cola a day? Coke’s fault. Accidentally pour coffee all over your dick and burn your boys to bits? Starbucks’s fault. Shoot yourself in the face losing a round of Russian roulette? Smith & Wesson’s fault. People like to say that this country was built on freedom or liberty. That’s bullshit. We aren’t even in the top 10 countries in the world when it comes to freedom. What this country was built on was people with their backs against the wall that had no other choice but to scratch and claw their way from the bottom of the heap. To fight and press to succeed, or die. Ingenuity, grit, determination. Lawsuits like this are a prime example of how we’re drifting further and further away from that attitude. We’re too cozy now and getting lazy.

[SFGate]  A Vacaville police officer who is a former Oakland Raiderette has filed a $1.5 million lawsuit against the city, saying she was sexually harassed and ostracized because of her cheerleader past. Nicole Rosenstiel, 35, of Yountville said in her federal civil-rights suit that she was subjected to jokes and unwelcome comments about her looks by fellow officers at the Vacaville Police Department, which she joined in 2004. She has been on unpaid leave since 2009. Colleagues made snide references to her having been a cheerleader for the Raiders from 1997 to 2001, said her suit, filed Monday in U.S. District Court in Sacramento. According to the suit, during a change of shift one day, a sergeant “asked for a show of hands by those officers who wanted to see plaintiff naked,” the suit says. One officer told Rosenstiel in front of other officers, “Nice rack,” according to the complaint. “Her supervisor told her that she should not work out in the department’s gym because she would draw attention to herself because of her appearance,” the suit said. “Altered photographs of her and Oakland Raiders ‘Raiderettes’ were posted with a caption, ‘Stay away from my daddy, bitch.’ ” “People just thought that it was OK to treat me like that,” Rosenstiel said in an interview Thursday. “No one deserves to be treated that way.” Mark Mazzaferro, a spokesman for the city of Vacaville, said, “We feel that the complaint is without merit, and we intend to litigate this vigorously.”

[Seattle Times]  Two Ohio men honored as heroes for their actions after a 2009 car crash are now suing the woman they rescued from a burning vehicle. The Columbus Dispatch reports the suit filed in central Ohio’s Marion County by David Kelley and Mark Kincaid claims Theresa Tanner was at fault and that saving her left the men with disabling injuries. They’re each seeking upwards of $25,000 in damages. Kelley tells the newspaper the smoke and fire did so much damage to his lungs that he can no longer carry a laundry basket upstairs in his home. He says he saw hair melting on Tanner’s head and is haunted by those memories. Court records don’t list an attorney for Tanner. Her husband told the Dispatch the family isn’t commenting.

Well, Theresa, what did you expect?  You think you can just crash and lie motionless in a burning car whenever you damn well please and the people who risk their own safety to save your life aren’t entitled to 25 large?  You’re gonna sit there with your scalp in flames and just stare blankly as you’re being rescued?  Really?  How selfish can you be?   (more…)
